সামাজিক রীতি অনুযায়ী বিবাহ মানব জীবনের অবিচ্ছেদ্য একটি অংশ। মানব মানবীর বিবাহের মধ্য দিয়ে পরবর্তী প্রজন্ম গড়ে ওঠে এবং মানবজাতীর গুরুত্বপূর্ণ উত্তরাধীকার স্বত্ব নির্ধারিত হয়। যুগে যুগে অঞ্চলভেদে গড়ে উঠেছে বিয়ের বহুমাত্রিক নিয়ম কানন। পৃথিবীর সব ধর্মগুলোতেই বিয়ের নিজস্ব কিছু রীতি-নীতি ঠিক করেছে। এসব রীতি নীতির সামান্য ব্যত্যয়ে কখনো কখনো মানব মানবীর এই গুরুত্বপূর্ণ সর্ম্পক অবৈধ হয়ে যায়। দেখা দেয় উত্তরাধিকার নিয়ে তুমুল হৈ চৈ।

বাংলাদেশের প্রেক্ষপটে আমরা আলোচনা করব হিন্দু বিবাহের কিছু নিয়ম কানন। আগেই বলে রাখি রাঙ্গামাটি, বান্দরবান আর কক্সবাজারে বেশ কিছু বৌদ্ধ ধর্মাবলম্বীদের বসবাস করতে দেখা যায়। তাদের বিবাহ ও তালাক সংক্রান্ত বিধি বিধানের সাথে হিন্দুদের সাথে কোনো তফাত নাই। বাংলাদেশের উচ্চ আদালত বেশ কয়েকটি রায়ে বলে দিয়েছে যে, বাংলাদেশের বৌদ্ধরা হিন্দু পারিবারীক আইন মোতাবেক পরিচালিত হবে।

হিন্দু বিবাহ
দু:খজনক হলেও সত্যি যে, বাংলাদেশের হিন্দু পারিবারিক আইন এখনো সেই আদিযুগে পড়ে আছে। যদিও আমাদের পার্শ্ববর্তী দেশ ভারত সনাতন হিন্দু আইন বাতিল করে আধুনিক হিন্দু পারিবারিক আইন প্রচলন করেছেন। যেমন ভারতে ছেলে মেয়েরা সমান অংশ সম্পত্তি পায়। বিবাহের জন্য নিবন্ধন বাধ্যতা মুলক। স্ত্রী চাইলে যে কোনে সময় তার স্বামীকে ডিভোর্স দিতে পারে। কিন্ত বাংলাদেশের চিত্র সম্পূর্ণ ভিন্ন। এখানের হিন্দু স্ত্রীরা তাদের স্বামীদের ডিভোর্স দিতে পারে না। বাবার সম্পত্তির পুরো অংশ সংসারের ছেলেরা লাভ করে। মেয়েদের কোনো স্থায়ী উত্তরাধিকারের সম্পত্তি নেই।

হিন্দু বিবাহ কি?
হিন্দু বিবাহ মানে আত্মার বন্ধন। সনাতন হিন্দু আইন অনুযায়ী হিন্দু বিয়েতে কোনো ডিভোর্স নেই। এই বিয়ে একবার হলে পরজন্ম পর্যন্ত টিকে থাকে। বৈধতা হিন্দু বিবাহের পূর্বশর্তসমূহ।

পাটিপত্র
পাটিপত্র বাঙালি হিন্দু বিবাহের প্রথম আচার। এই আচার লগ্নপত্র বা মঙ্গলাচরণ নামেও পরিচিত। ঘটকের মাধ্যমে সম্বন্ধ করে বিবাহ স্থির হলে নগদ বা গহনাপত্রে যৌতুক ও অন্যান্য দেনাপাওনা চূড়ান্তভাবে স্থির করার জন্য যে অনুষ্ঠান হয়, তাকেই পাটিপত্র বলে। এই আচারের মাধ্যমেই বিবাহের অন্যান্য আচারের সূচনা ঘটে।

আদর্শ জীবনসঙ্গী খুঁজতে

পানখিল
পানখিল বাঙালি হিন্দু বিবাহের দ্বিতীয় আচার। এটি পাটিপত্রের ঠিক পরেই পালিত হয়। পানখিলের অর্থ পান পাতায় আনুষ্ঠানিকভাবে খিল দেওয়া বা খড়কে বেঁধানো। এই আচারটি প্রথমে বরের বাড়িতে এবং পরে কনের বাড়িতে অনুষ্ঠিত হয়। পানখিল আচারে বাড়ির মেয়েরা এবং প্রতিবেশিনীরা বিয়ের গান গেয়ে থাকে। এই গানের বিষয়বস্তু হল রাম ও সীতার বিবাহ।

দধি মঙ্গল
দধি মঙ্গল বিবাহের দিন বর ও কন্যার উপবাস। তবে উপবাস নির্জলা নয়। জল মিষ্টি খাওয়ার বিধান আছে। তাই সারাদিনের জন্য সূর্যোদয়ের আগে বর ও কন্যাকে চিড়ে ও দৈ খাওয়ানো হয়।

গায়ে হলুদ
গায়ে হলুদ সংস্কৃত ভাষায় এই রীতিকে বলা হয় গাত্রহরিদ্রা। হিন্দু ধর্মে কয়েকটি জিনিসকে শুভ বলা হয়। যেমন শঙ্খধ্বনি, হলুদ ইত্যাদি। প্রথমে বরকে ও নিতবরকে সারা গায়ে হলুদ মাখানো হয়। পরে সেই হলুদ কন্যার বাড়ি পাঠানো হয়। কন্যাকে সেই হলুদ মাখানো হয়।

শঙ্খ কঙ্কন: শঙ্খ কঙ্কন কন্যাকে শাঁখা পরানো হয়। এরপর বিকালে বিবাহের মূল অনুষ্ঠান শুরু হয়

বর বরণ: বর বিবাহ করতে এলে তাকে স্বাগত জানান কন্যাপক্ষ। সাধাবনত: কন্যার মা তার জামাতাকে একটি থালায় প্রদীপ, ধান দুর্ব্ব ও অন্যান্য কিছু বরণ সামগ্রী নিয়ে বরণ করেন। এরপর বরকে বাড়ির ভিতরে নিয়ে যাওয়া হয় ও দুধ এবং মিষ্টি খাওয়ানো হয়।

সাত পাক বা সপ্তপদী: সাত পাক বিবাহের মণ্ন্ডপে প্রথমে বরকে আনা হয়। এরপর কন্যাকে পিঁড়িতে বসিয়ে আনা হয়। সাধারণত: কন্যার জামাইবাবুরা পিঁড়ি ধরে থাকেন। কন্যা পান পাতা দিয়ে নিজের মুখ ঢেকে রাখেন। কন্যাকে পিঁড়িতে করে বরের চারপাশে সাতপাক ঘোরানো হয়।

বিভাহোমা: বর ও কন্যার আগুনের সামনে প্রার্থনা।

শুভদৃষ্টি: শুভদৃষ্টি  বিবাহের মণ্ডপে জনসমক্ষে বর ও কন্যা একে অপরের দিকে চেয়ে দেখন।

মালা বদল: মালা বদল কন্যা ও বর মালাবদল করেন। এই রীতির অর্থ হচ্ছে দুজন একে অন্যকে জীবনসঙ্গী হিসাবে মেনে নিলেন। মুসলমান মতে একই ভাবে কন্যাকে বলতে হয় “কবুল”।

সম্প্রদান: সম্প্রদান কন্যার পিতা কন্যাকে জামাতার হাতে সম্প্রদান করেন বেদমন্ত্রে। বরও জানান যে তিনি কন্যার ভরন পোষনের দ্বায়িত্ব নিলেন। বিবাহের মন্ত্র হল “যদেতৎ হৃদয়ং তব তদস্তু হৃদয়ং মম। যদিদং হৃদয়ং মম, তদস্তু হৃদয়ং তব।”

অঞ্জলি: অঞ্জলি কন্যা ও বর খৈ অগ্নাহুতি দেন। প্রচলিত বাংলায় একে বলে খৈ পোড়া। বৈদিক যুগে মানুষ নানা ধরনের শক্তির উপাসনা করতেন। অগ্নিও তাদের মধ্যে অন্যতম।

সিঁদুর দান: সিঁদুর দান বিবাহের শেষ রীতি হল বর কন্যার কপালে সিঁদুর লেপন করেন। বাঙালি হিন্দু নারীরা স্বামীর মঙ্গল কামনায় সিঁদুর পরেন।

হিসেব করলে হিন্দু বিবাহের নিয়মের কোনো শেষ নেই। এতগুলো শর্ত স্বাভাবিকভাবে পালন করা সব সময় সবক্ষেত্রে হয়ত সম্ভবও হয় না। তাই ঝামেলা এড়াতে বাংলাদেশের উচ্চ আদালত ১৯৯৮ সালে এক রায়ের মাধ্যমে হিন্দু বিবাহের প্রধান দুইটি শর্ত নির্ধারণ করে দিয়েছে।

শর্ত দুইটি হল- সপ্তপদী ও বিভাহোমা। এই দুইটি শর্ত পালন হলেই ধরে নেওয়া হবে হিন্দু বিবাহ বৈধ।

হিন্দু বিবাহে ছেলে মেয়েদের বয়স
হিন্দু সনাতন আইনে বিয়ের ক্ষেত্রে ছেলে মেয়ের কোনো বয়স নির্ধারণ করা হয় নাই। যে কোনো বয়সের ছেলে মেয়ে বিয়ের বন্ধনে আবদ্ধ হতে পারবে। তবে বর্তমানে বাংলাদেশে বাল্যবিবাহ নিরোধ আইন-১৯২৯ অনুযায়ী মেয়েদের ১৮ আর পুরুষদের ২১ বছর আগে বিয়ে করা শাস্তিযোগ্য অপরাধ। তবে বিয়ে একবার সম্পন্ন হয়ে গেলে বিয়ে বৈধ হয়ে যাবে। কেবল যে  বিয়ে সম্পাদন করেছে বা ছেলে মেয়ের অভিভাবকদের শাস্তি পেতে হবে।

হিন্দু বিবাহের নিবন্ধন
২০১২ সালে হিন্দু বিবাহ নিবন্ধন আইন নামে সরকার একটি আইন পাশ করে। যেখানে হিন্দু বিবাহের নিবন্ধন করার ব্যবস্থা্ ও পদ্ধতি বর্ণনা করা হয়েছে। তবে উদ্বেগজনক ব্যাপার হল- এই নিবন্ধন বাধ্যতামূলক করা হয় নি। যার কারণে কেউ যদি বিবাহ করে নিবন্ধন না করে তবে তার কোনো মাস্তি হবে না এমনকি বিবাহ বৈধও হবে না।

সমাজ পরিবর্তনের পাশাপাশি সমাজের আইন কাননও বদলে যায়। সময়ের চাহিদা মোতাবেক তৈরি হয় যুগোপযোগী আইন। বাংলাদেশে হিন্দু বিবাহের ক্ষেত্রে যুগরে সাথে তাল মিলিয়ে কিছু পরিবর্তন জরুরি হয়ে পড়েছে। যা কেবল সময়ের দাবি।
